Welcome to Sunset Core, LLC (“Sunset Core,” “the Studio,” “we,” “our,” or “us”), a boutique fitness studio located in Santa Monica, California. These Terms of Service and Conditions (“Terms”) govern your use of the services, classes, and facilities provided by the Studio, whether in-person or online. By accessing our website or app (collectively “Site”), purchasing products or services from us, or using our services in any way, including booking or taking any of our classes, (collectively, “Services”), you agree to abide by these Terms. These Terms apply to all users of our Services, including, without limitation, browsers, vendors, customers, merchants, and/or contributors of content. Please read these Terms carefully before using our Services. If you do not agree with any part of these Terms, you must not use any of our Services.

Please note: We may periodically update these Terms without notice by posting a revised version on this site. It is your responsibility to check these Terms regularly. Your continued use of Sunset Core’s website, app, or services after any changes to these Terms signifies your acceptance of the updated Terms. These Terms contain provisions that limit our liability to you.

1. General Conditions

• Services may be modified or updated periodically. The availability and nature of Services will be as outlined on our website and/or app and as specified in your membership(s) or class package(s). Furthermore, we reserve the right to refuse service to anyone for any reason at any time. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
• The content and materials available on this Site are provided solely for your personal, non-commercial use. You agree not to distribute, publish, transmit, modify, display, create derivative work from, or exploit any of the content or materials, except as expressly permitted by these Terms. Additionally, you may not use our products or services for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws) while using the Site.
• Unauthorized use of these materials or products may result in irreparable harm to Sunset Core, and in such cases, Sunset Core reserves the right to seek equitable relief, including injunctive relief, specific performance, and any other legal remedies available, without the need to post a bond or demonstrate actual damages.

2. Eligibility

You must be at least 18 years old to use our services. By registering for classes or using our Services, you represent and warrant that you are at least 18 years of age or will be supervised by a parent/guardian when using our Services and accompanied by a parent/guardian when enrolling in and taking our classes.

3. Class Registration and Payments

• Registration: All classes must be booked in advance through our website, app, or in-person at the studio.
• Payment: Payment is due at the time of booking. We accept various payment methods, including credit/debit cards and other approved methods. You will not be able to participate in any of Sunset Core’s services, including any classes, if you have not paid in full prior to the start of class.

4. Membership and Class Packages

Sunset Core offers various memberships and class packages, all of which are governed by these Terms. In addition, it is your responsibility to review the Studio Policies. By agreeing to these Terms, you are also agreeing to all of the Studio’s policies as outlined on Sunset Core’s Studio Policies page on our website.

a. Membership Options

We offer different membership plans. Membership details, pricing, and benefits are provided upon registration and may be subject to change. Memberships are non-transferable.
For monthly memberships which automatically renew, you expressly agree that your credit card on file with be charged at the time of purchase and then once 30-days thereafter for the length of the contract for which you have entered.

b. Class Packages

You may also purchase class packages, which are valid for a set number of classes.

c. Payment Terms

All payments for memberships or class packages are due upfront. Recurring payments for memberships are billed automatically according to the selected plan.

5. Cancellations, Refunds, and Waitlist Booking Policy

We understand that plans change. You may cancel or reschedule your session according to the following policies below. Please note the definitions for late cancel and no show.

A late cancel occurs when you cancel a class less than 12 hours before its scheduled start time.

A no show occurs when you fail to cancel a class entirely and then do not show up for your scheduled class.

• Single Sessions: Cancellations made at least 12 hours before the session will receive a full refund. Cancellations made less than 12 hours before the session will incur a fee or result in forfeiture of the session.

• Memberships: A fee of $20 per class will be charged for cancellations made within 12 hours of the scheduled class time. A no-show fee of $20 per class will be charged for failing to attend a class without prior notice or cancellation.

• Class Pack Holders: Forfeiture of class credit will occur for missed or late-cancelled classes.

• ClassPass Clients: You must manage your ClassPass bookings directly through ClassPass. Sunset Core cannot modify or cancel your ClassPass bookings. You are still bound by Sunset Core’s cancellation, refund, and waitlist policies in addition to your contractual duties with ClassPass.

Waitlist Policy: If you are on the waitlist, you may be automatically booked into the class if space becomes available up to 12 hours before the class start time. Once moved to a confirmed booking, the standard cancellation, refund, and waitlist policies apply.

6. Late Policy

You will not be admitted to enter the Studio if you arrive more than 10 minutes after your scheduled class. If you do arrive more than 10 minutes after your scheduled class, you will incur a fee or forfeiture of the session. For memberships, you will incur a no-show fee of $20. For class pack holders, you will forfeit a class.

7. Modification to the Services and Pricing

We reserve the right to modify or discontinue any of our Services (or any part thereof) at any time and without advanced notice to you. Pricing for our Services is subject to change without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

8. Modifications to the Website or App

Sunset Core reserves the right to modify, suspend, or discontinue the Site or app, or any features or portions thereof, at any time, temporarily or permanently, without prior notice. You agree that Sunset Core shall not be held liable for any modification, suspension, or discontinuance of the Site or any part of it.

9. Disclaimer of Warranties and Limitation of Liability

a. Disclaimer

Except as expressly stated otherwise, the content on this Site is provided “as is,” without any warranty, express or implied. Sunset Core makes no representations regarding the completeness, accuracy, or timeliness of the information on this Site. To the fullest extent permitted by law, Sunset Core disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and expectations of privacy. Sunset Core does not guarantee that the functions of this Site will be uninterrupted, error-free, or that this Site or its server will be free from viruses or other harmful components.

b. Limitation of Liability

Sunset Core, including its owners, managers, officers, directors, affiliates, subsidiaries, agents, and employees, will not be liable for any damages or injuries arising from your use of the Site. This includes, but is not limited to, damages resulting from performance failures, errors, omissions, interruptions, defects, delays in operation or transmission, computer viruses, or line failures.

You agree not to copy, distribute, or use any of the Studio’s intellectual property without our explicit permission.

12. Privacy and Data Collection

a. Personal Information:

We collect personal information from clients as part of the registration and membership process. This information will be used solely for the purpose of managing your membership, providing services, and communicating regarding your participation in the Studio’s programs.

b. Privacy Policy:

Our Privacy Policy outlines the types of personal information we collect, how it is used, and how it is protected. By using our Services and/or Site, you consent to the collection and use of your personal information as described in our Privacy Policy.

13. Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. These restrictions may apply to orders placed using the same customer account, credit card, or billing and/or shipping address. If we modify or cancel an order, we will make reasonable efforts to notify you using the email address or billing contact information provided at the time of purchase.

These Terms are governed by and construed in accordance with the laws of the state of California.
